关于完善质量保障体系提升建筑工程品质的若干措施

  为深入贯(guan)彻落实《国(guo)务(wu)院办公厅转发(fa)住(zhu)房(fang)城乡建(jian)设部关于完(wan)善质(zhi)量(liang)保障体(ti)(ti)系提(ti)升建(jian)筑工(gong)程品(pin)质(zhi)指导意见(jian)的通(tong)知》(国(guo)办函〔2019〕92号(hao))要求,解决建(jian)筑工(gong)程质(zhi)量(liang)管理领(ling)域(yu)面(mian)临(lin)的突出问题,完(wan)善质(zhi)量(liang)保障体(ti)(ti)系,提(ti)升建(jian)筑工(gong)程品(pin)质(zhi),推动(dong)(dong)建(jian)筑业发(fa)展(zhan)质(zhi)量(liang)变(bian)革(ge)、效率变(bian)革(ge)、动(dong)(dong)力变(bian)革(ge),结合我(wo)省实际,制定如下(xia)措(cuo)施。

  一、突出建设(she)(she)单(dan)(dan)(dan)位首要责(ze)(ze)任(ren)(ren)。建设(she)(she)单(dan)(dan)(dan)位应(ying)切实(shi)担负工(gong)(gong)(gong)程(cheng)(cheng)质量(liang)首要责(ze)(ze)任(ren)(ren),严(yan)格履行工(gong)(gong)(gong)程(cheng)(cheng)建设(she)(she)法定程(cheng)(cheng)序和(he)项(xiang)目(mu)法人责(ze)(ze)任(ren)(ren)制,保证(zheng)合(he)理工(gong)(gong)(gong)期(qi)和(he)造价(jia),实(shi)行优(you)质优(you)价(jia),不(bu)(bu)得(de)违法违规(gui)发包工(gong)(gong)(gong)程(cheng)(cheng),不(bu)(bu)得(de)要求参建单(dan)(dan)(dan)位低于成本(ben)价(jia)承接(jie)业(ye)务,不(bu)(bu)得(de)随意(yi)压缩合(he)理工(gong)(gong)(gong)期(qi),不(bu)(bu)得(de)拖欠工(gong)(gong)(gong)程(cheng)(cheng)预付款。建设(she)(she)单(dan)(dan)(dan)位应(ying)明确项(xiang)目(mu)质量(liang)终身责(ze)(ze)任(ren)(ren)人,加强对工(gong)(gong)(gong)程(cheng)(cheng)建设(she)(she)全过程(cheng)(cheng)的质量(liang)管理。建立工(gong)(gong)(gong)程(cheng)(cheng)质量(liang)信息(xi)公(gong)示制度(du),建设(she)(she)单(dan)(dan)(dan)位应(ying)主动公(gong)开施工(gong)(gong)(gong)许可、主要建筑材料、实(shi)体质量(liang)及抗震设(she)(she)计要求、工(gong)(gong)(gong)程(cheng)(cheng)竣(jun)工(gong)(gong)(gong)验(yan)收等(deng)信息(xi),接(jie)受社(she)会监督(du)。(省(sheng)住房城乡建设(she)(she)厅、省(sheng)发展改革委负责(ze)(ze))

  二(er)、强(qiang)化(hua)施(shi)工(gong)单(dan)(dan)位(wei)主体(ti)责(ze)(ze)(ze)任(ren)。施(shi)工(gong)单(dan)(dan)位(wei)对(dui)建(jian)(jian)筑工(gong)程的施(shi)工(gong)质(zhi)(zhi)量(liang)(liang)负(fu)责(ze)(ze)(ze),不得转包、违法分包工(gong)程。施(shi)工(gong)单(dan)(dan)位(wei)应(ying)建(jian)(jian)立健(jian)全(quan)公司和(he)项(xiang)目部两级质(zhi)(zhi)量(liang)(liang)管理(li)(li)(li)体(ti)系,建(jian)(jian)立岗位(wei)责(ze)(ze)(ze)任(ren)制度,设置质(zhi)(zhi)量(liang)(liang)管理(li)(li)(li)机构,配备专职(zhi)质(zhi)(zhi)量(liang)(liang)负(fu)责(ze)(ze)(ze)人和(he)质(zhi)(zhi)量(liang)(liang)管理(li)(li)(li)员(yuan),加强(qiang)对(dui)所承接项(xiang)目的全(quan)面质(zhi)(zhi)量(liang)(liang)管理(li)(li)(li),不得以(yi)包代管。施(shi)工(gong)单(dan)(dan)位(wei)应(ying)建(jian)(jian)立落(luo)实工(gong)程质(zhi)(zhi)量(liang)(liang)安(an)全(quan)手册制度和(he)质(zhi)(zhi)量(liang)(liang)责(ze)(ze)(ze)任(ren)标识制度,将(jiang)工(gong)程质(zhi)(zhi)量(liang)(liang)管理(li)(li)(li)要求落(luo)实到(dao)每个项(xiang)目和(he)员(yuan)工(gong),强(qiang)化(hua)工(gong)程质(zhi)(zhi)量(liang)(liang)相关技术标准执行力,对(dui)项(xiang)目关键(jian)工(gong)序、关键(jian)部位(wei)隐蔽(bi)工(gong)程实施(shi)举牌(pai)验收,加强(qiang)施(shi)工(gong)记录和(he)验收资料(liao)管理(li)(li)(li),实现质(zhi)(zhi)量(liang)(liang)责(ze)(ze)(ze)任(ren)可追溯。(省住房城乡建(jian)(jian)设厅负(fu)责(ze)(ze)(ze))

  三、压实检(jian)测(ce)(ce)(ce)(ce)(ce)单位(wei)的质量(liang)监测(ce)(ce)(ce)(ce)(ce)责(ze)任(ren)。建(jian)筑工(gong)(gong)程质量(liang)检(jian)测(ce)(ce)(ce)(ce)(ce)机构(gou)(gou)应当(dang)按(an)照(zhao)法律法规(gui)、技术标准和(he)检(jian)测(ce)(ce)(ce)(ce)(ce)合同开展检(jian)测(ce)(ce)(ce)(ce)(ce)活动,对(dui)检(jian)测(ce)(ce)(ce)(ce)(ce)数(shu)据、检(jian)测(ce)(ce)(ce)(ce)(ce)结论和(he)检(jian)测(ce)(ce)(ce)(ce)(ce)报(bao)告的真实性和(he)准确性负责(ze),不得弄(nong)虚作假。检(jian)测(ce)(ce)(ce)(ce)(ce)单位(wei)应将检(jian)测(ce)(ce)(ce)(ce)(ce)过程中发现的违反有关法律法规(gui)和(he)工(gong)(gong)程建(jian)设(she)强制性标准以及(ji)涉及(ji)结构(gou)(gou)安全检(jian)测(ce)(ce)(ce)(ce)(ce)结果不符合要求(qiu)的情况,及(ji)时报(bao)告工(gong)(gong)程所在地(di)住(zhu)房城乡建(jian)设(she)主管(guan)部门。(省(sheng)住(zhu)房城乡建(jian)设(she)厅、省(sheng)市场监管(guan)局(ju)负责(ze))

  四、明确房(fang)(fang)(fang)(fang)(fang)屋(wu)(wu)(wu)(wu)(wu)使(shi)用(yong)安(an)全(quan)(quan)主体责任(ren)。房(fang)(fang)(fang)(fang)(fang)屋(wu)(wu)(wu)(wu)(wu)所(suo)有(you)(you)权(quan)人应承担房(fang)(fang)(fang)(fang)(fang)屋(wu)(wu)(wu)(wu)(wu)使(shi)用(yong)安(an)全(quan)(quan)主体责任(ren)。房(fang)(fang)(fang)(fang)(fang)屋(wu)(wu)(wu)(wu)(wu)所(suo)有(you)(you)权(quan)人和(he)使(shi)用(yong)人应正确使(shi)用(yong)和(he)维护(hu)房(fang)(fang)(fang)(fang)(fang)屋(wu)(wu)(wu)(wu)(wu),严禁擅自(zi)变动房(fang)(fang)(fang)(fang)(fang)屋(wu)(wu)(wu)(wu)(wu)建筑主体和(he)承重结构(gou)。加强(qiang)房(fang)(fang)(fang)(fang)(fang)屋(wu)(wu)(wu)(wu)(wu)使(shi)用(yong)安(an)全(quan)(quan)管(guan)理,房(fang)(fang)(fang)(fang)(fang)屋(wu)(wu)(wu)(wu)(wu)所(suo)有(you)(you)权(quan)人及其委托的管(guan)理服(fu)务单位要定(ding)期对房(fang)(fang)(fang)(fang)(fang)屋(wu)(wu)(wu)(wu)(wu)安(an)全(quan)(quan)进(jin)行检查,有(you)(you)效履(lv)行房(fang)(fang)(fang)(fang)(fang)屋(wu)(wu)(wu)(wu)(wu)维修保养(yang)义务,切实保证(zheng)房(fang)(fang)(fang)(fang)(fang)屋(wu)(wu)(wu)(wu)(wu)使(shi)用(yong)安(an)全(quan)(quan)。(省住房(fang)(fang)(fang)(fang)(fang)城乡建设厅(ting)(ting)、省应急厅(ting)(ting)、省市场监管(guan)局(ju)等部门按照各(ge)自(zi)职(zhi)责负责)

  五、履行(xing)政府的(de)工(gong)程(cheng)(cheng)质量(liang)(liang)监(jian)(jian)(jian)(jian)管(guan)责任(ren)。强化(hua)政府对(dui)工(gong)程(cheng)(cheng)建(jian)(jian)设全(quan)过程(cheng)(cheng)的(de)质量(liang)(liang)监(jian)(jian)(jian)(jian)管(guan),健全(quan)省、市、县工(gong)程(cheng)(cheng)质量(liang)(liang)监(jian)(jian)(jian)(jian)管(guan)体系,鼓励采取政府购买(mai)服务(wu)等方式,委(wei)托具备条件的(de)社(she)会力量(liang)(liang)进行(xing)工(gong)程(cheng)(cheng)质量(liang)(liang)监(jian)(jian)(jian)(jian)督检查(cha)(cha)(cha)(cha)(cha)(cha)(cha)和抽(chou)测(ce)(ce)。完(wan)善监(jian)(jian)(jian)(jian)督机构日常巡查(cha)(cha)(cha)(cha)(cha)(cha)(cha)检查(cha)(cha)(cha)(cha)(cha)(cha)(cha)、抽(chou)查(cha)(cha)(cha)(cha)(cha)(cha)(cha)抽(chou)测(ce)(ce)与(yu)工(gong)程(cheng)(cheng)质量(liang)(liang)管(guan)理(li)(li)(li)标准化(hua)项目考(kao)评相结合的(de)质量(liang)(liang)监(jian)(jian)(jian)(jian)督检查(cha)(cha)(cha)(cha)(cha)(cha)(cha)制度,全(quan)面(mian)(mian)推(tui)行(xing)“双随机、一公开”检查(cha)(cha)(cha)(cha)(cha)(cha)(cha)方式和“互联网(wang) 监(jian)(jian)(jian)(jian)管(guan)”模(mo)式,落实(shi)监(jian)(jian)(jian)(jian)管(guan)责任(ren)。推(tui)动(dong)质量(liang)(liang)管(guan)理(li)(li)(li)标准化(hua)考(kao)评结果应用(yong),实(shi)现市场(chang)与(yu)现场(chang)联动(dong)。开展施(shi)工(gong)图(tu)审(shen)(shen)(shen)查(cha)(cha)(cha)(cha)(cha)(cha)(cha)机构治理(li)(li)(li),优化(hua)施(shi)工(gong)图(tu)审(shen)(shen)(shen)查(cha)(cha)(cha)(cha)(cha)(cha)(cha)机构考(kao)评体系,提(ti)升(sheng)审(shen)(shen)(shen)查(cha)(cha)(cha)(cha)(cha)(cha)(cha)机构的(de)审(shen)(shen)(shen)查(cha)(cha)(cha)(cha)(cha)(cha)(cha)质量(liang)(liang)和服务(wu)水平(ping)。加快实(shi)行(xing)施(shi)工(gong)图(tu)BIM审(shen)(shen)(shen)查(cha)(cha)(cha)(cha)(cha)(cha)(cha),推(tui)动(dong)施(shi)工(gong)图(tu)审(shen)(shen)(shen)查(cha)(cha)(cha)(cha)(cha)(cha)(cha)模(mo)式由(you)二维(wei)(wei)图(tu)纸向三维(wei)(wei)模(mo)型转(zhuan)变(bian),全(quan)面(mian)(mian)提(ti)高工(gong)程(cheng)(cheng)设计(ji)质量(liang)(liang)。建(jian)(jian)立全(quan)省勘察设计(ji)行(xing)业信用(yong)体系,促进行(xing)业监(jian)(jian)(jian)(jian)管(guan)向信用(yong)管(guan)理(li)(li)(li)转(zhuan)变(bian)。(省住(zhu)房城乡建(jian)(jian)设厅、省发展改革委(wei)负(fu)责)

  六、改革(ge)工程(cheng)(cheng)(cheng)建(jian)设组织模式。积极推(tui)(tui)动全(quan)过程(cheng)(cheng)(cheng)工程(cheng)(cheng)(cheng)咨询(xun)发展,规范全(quan)过程(cheng)(cheng)(cheng)工程(cheng)(cheng)(cheng)咨询(xun)招标投(tou)(tou)标活动,鼓(gu)励(li)工程(cheng)(cheng)(cheng)咨询(xun)企业融合发展、资(zi)质(zhi)(zhi)增项。严格落实工程(cheng)(cheng)(cheng)咨询(xun)、勘(kan)察设计、监(jian)理、造价(jia)等(deng)领(ling)域执业资(zi)格人(ren)员的(de)(de)质(zhi)(zhi)量责(ze)任。政府投(tou)(tou)资(zi)和(he)国有(you)资(zi)金投(tou)(tou)资(zi)的(de)(de)项目应带头推(tui)(tui)行全(quan)过程(cheng)(cheng)(cheng)工程(cheng)(cheng)(cheng)咨询(xun)服务,鼓(gu)励(li)民(min)间(jian)投(tou)(tou)资(zi)项目积极采用(yong)全(quan)过程(cheng)(cheng)(cheng)工程(cheng)(cheng)(cheng)咨询(xun)服务。推(tui)(tui)行工程(cheng)(cheng)(cheng)总(zong)承包(bao),落实工程(cheng)(cheng)(cheng)总(zong)承包(bao)单(dan)位(wei)在(zai)工程(cheng)(cheng)(cheng)质(zhi)(zhi)量安(an)全(quan)、进度控制(zhi)、成本管理等(deng)方面的(de)(de)责(ze)任。完善专业分包(bao)制(zhi)度,积极培育具有(you)特色优势的(de)(de)专业承包(bao)和(he)劳务企业。在(zai)民(min)用(yong)建(jian)筑中(zhong)充分发挥建(jian)筑师(shi)主导作(zuo)用(yong),推(tui)(tui)行建(jian)筑师(shi)负责(ze)制(zhi)。(省(sheng)(sheng)住房城乡建(jian)设厅、省(sheng)(sheng)财政厅、省(sheng)(sheng)发展改革(ge)委(wei)负责(ze))

  七、强(qiang)化(hua)(hua)工程(cheng)(cheng)招(zhao)(zhao)(zhao)(zhao)投标(biao)(biao)(biao)(biao)管(guan)(guan)(guan)理(li)。构建全(quan)省规则统一(yi)(yi)的招(zhao)(zhao)(zhao)(zhao)投标(biao)(biao)(biao)(biao)市(shi)场,营(ying)造(zao)公开、公平(ping)、公正的营(ying)商环境。加强(qiang)信息化(hua)(hua)建设(she),打(da)造(zao)全(quan)电子(zi)化(hua)(hua)招(zhao)(zhao)(zhao)(zhao)投标(biao)(biao)(biao)(biao)和(he)监管(guan)(guan)(guan)流程(cheng)(cheng),形成“全(quan)省一(yi)(yi)张网”。全(quan)面推(tui)(tui)行(xing)远程(cheng)(cheng)异地评(ping)标(biao)(biao)(biao)(biao)。建立以信用为(wei)核(he)心(xin)的招(zhao)(zhao)(zhao)(zhao)投标(biao)(biao)(biao)(biao)市(shi)场监管(guan)(guan)(guan)体(ti)制,推(tui)(tui)动简政放权(quan)和(he)政府职能转变,简化(hua)(hua)招(zhao)(zhao)(zhao)(zhao)标(biao)(biao)(biao)(biao)投标(biao)(biao)(biao)(biao)程(cheng)(cheng)序,强(qiang)化(hua)(hua)招(zhao)(zhao)(zhao)(zhao)标(biao)(biao)(biao)(biao)主(zhu)体(ti)责任追(zhui)溯(su),提升(sheng)工程(cheng)(cheng)质(zhi)量安全(quan)水平(ping)。强(qiang)化(hua)(hua)招(zhao)(zhao)(zhao)(zhao)标(biao)(biao)(biao)(biao)主(zhu)体(ti)责任和(he)招(zhao)(zhao)(zhao)(zhao)投标(biao)(biao)(biao)(biao)事中事后监管(guan)(guan)(guan)、合同(tong)履约监管(guan)(guan)(guan),严厉打(da)击围标(biao)(biao)(biao)(biao)、串标(biao)(biao)(biao)(biao)和(he)虚假招(zhao)(zhao)(zhao)(zhao)标(biao)(biao)(biao)(biao)等违法行(xing)为(wei)。严格评(ping)标(biao)(biao)(biao)(biao)专家管(guan)(guan)(guan)理(li),落实“一(yi)(yi)项目一(yi)(yi)考评(ping)”制度,健(jian)全(quan)评(ping)标(biao)(biao)(biao)(biao)专家库专家征(zheng)集、培训、考核(he)和(he)清退(tui)机(ji)制,完善评(ping)标(biao)(biao)(biao)(biao)专家管(guan)(guan)(guan)理(li)机(ji)制。(省发展改革委、省住房城乡(xiang)建设(she)厅负责)

  八、推(tui)行(xing)工(gong)(gong)程(cheng)(cheng)(cheng)担保(bao)(bao)(bao)与保(bao)(bao)(bao)险。加快推(tui)进(jin)银(yin)行(xing)保(bao)(bao)(bao)函(han)、工(gong)(gong)程(cheng)(cheng)(cheng)担保(bao)(bao)(bao)公司保(bao)(bao)(bao)函(han)和(he)工(gong)(gong)程(cheng)(cheng)(cheng)保(bao)(bao)(bao)证保(bao)(bao)(bao)险制度,扩大工(gong)(gong)程(cheng)(cheng)(cheng)保(bao)(bao)(bao)证保(bao)(bao)(bao)险试(shi)(shi)点范围,鼓励保(bao)(bao)(bao)险公司根(gen)据实(shi)际情况开(kai)(kai)发新(xin)的(de)(de)险种(zhong),推(tui)行(xing)工(gong)(gong)程(cheng)(cheng)(cheng)款支付担保(bao)(bao)(bao)。开(kai)(kai)展工(gong)(gong)程(cheng)(cheng)(cheng)质(zhi)量(liang)保(bao)(bao)(bao)险试(shi)(shi)点,完(wan)善工(gong)(gong)程(cheng)(cheng)(cheng)质(zhi)量(liang)保(bao)(bao)(bao)证和(he)保(bao)(bao)(bao)修机(ji)制。对采用(yong)最(zui)低(di)价中标的(de)(de)探索(suo)实(shi)行(xing)高(gao)保(bao)(bao)(bao)额履约担保(bao)(bao)(bao)。开(kai)(kai)展国家、省(sheng)关于(yu)“推(tui)行(xing)承诺制”的(de)(de)政(zheng)策宣贯工(gong)(gong)作,确保(bao)(bao)(bao)招标投标担保(bao)(bao)(bao)和(he)履约担保(bao)(bao)(bao)管(guan)理(li)暂行(xing)办法等政(zheng)策文件全面落实(shi)。(省(sheng)住房城乡建设(she)厅(ting)、省(sheng)发展改革委(wei)、省(sheng)财(cai)政(zheng)厅(ting)、湖南银(yin)保(bao)(bao)(bao)监局负责)

  十九、加强(qiang)社(she)会监(jian)(jian)督(du)。发挥行业(ye)(ye)(ye)监(jian)(jian)督(du)、行政(zheng)监(jian)(jian)督(du)、纪(ji)检(jian)监(jian)(jian)察监(jian)(jian)督(du)、企业(ye)(ye)(ye)相(xiang)互监(jian)(jian)督(du)、社(she)会公(gong)众监(jian)(jian)督(du)的作用,拓宽监(jian)(jian)督(du)渠(qu)道,形成监(jian)(jian)督(du)合(he)力。推行住(zhu)宅工(gong)程(cheng)质(zhi)量(liang)(liang)信(xin)息(xi)向(xiang)(xiang)(xiang)社(she)会公(gong)示试点。完(wan)善信(xin)息(xi)公(gong)开制(zhi)度,除涉(she)及(ji)国家秘密、商业(ye)(ye)(ye)秘密以外,合(he)同(tong)订立、项目变(bian)动、合(he)同(tong)变(bian)更、合(he)同(tong)中止(zhi)和(he)(he)解(jie)除、违约(yue)行为处理(li)(li)(li)结果、竣工(gong)验收等合(he)同(tong)履约(yue)情(qing)况(kuang)信(xin)息(xi)全(quan)部向(xiang)(xiang)(xiang)社(she)会公(gong)开。各地应完(wan)善建(jian)筑(zhu)工(gong)程(cheng)质(zhi)量(liang)(liang)投诉(su)和(he)(he)纠纷协调处理(li)(li)(li)机制(zhi),按(an)照(zhao)“属地管理(li)(li)(li)、分(fen)级负(fu)责(ze)”和(he)(he)“谁主管、谁负(fu)责(ze)”的处理(li)(li)(li)原(yuan)则,依法、公(gong)正、及(ji)时(shi)、就(jiu)地解(jie)决工(gong)程(cheng)质(zhi)量(liang)(liang)投诉(su)问题,维护投诉(su)当(dang)事人合(he)法权(quan)益,定期向(xiang)(xiang)(xiang)社(she)会通(tong)报(bao)建(jian)筑(zhu)工(gong)程(cheng)质(zhi)量(liang)(liang)投诉(su)处理(li)(li)(li)情(qing)况(kuang)。(省(sheng)住(zhu)房(fang)城乡建(jian)设厅、省(sheng)市场监(jian)(jian)管局负(fu)责(ze))

  二十、精心组织实施。各(ge)级各(ge)有关部(bu)门要切(qie)实履行(xing)好工(gong)(gong)(gong)程(cheng)质量监(jian)管责任,将建(jian)(jian)筑工(gong)(gong)(gong)程(cheng)品质提升工(gong)(gong)(gong)作纳入重要议事(shi)日程(cheng),加强统筹规划,细化(hua)(hua)工(gong)(gong)(gong)作任务(wu),完(wan)善保障措施,确保各(ge)项任务(wu)措施真正落地(di)。强化(hua)(hua)示范引领,鼓励有条件的(de)地(di)区积极开展改(gai)革(ge)创新(xin)试点(dian),形成可复制、可推广(guang)的(de)经(jing)验(yan),不断(duan)完(wan)善建(jian)(jian)筑工(gong)(gong)(gong)程(cheng)品质创新(xin)管理制度。加强舆(yu)论引导,及时宣传各(ge)地(di)的(de)好经(jing)验(yan)、好做法,营造(zao)良好社(she)会(hui)氛(fen)围。
